Terms and Conditions
Customers accept that by placing an order they accept these Terms & Conditions.
Nothing in these Terms & Conditions shall affect the statutory rights of any buyer dealing as a consumer.
All images, descriptions, specifications and advertising on our website or elsewhere are for the sole purpose of providing an approximate description of the goods and are intended as a guide only.
Our arena mirrors are delivered ready to install but fixings need be sourced separately. It is the buyer’s responsibility to ensure the fixings are suitable for purpose.
Delivery is made with a transit type van. There must be a road or drive to the point of drop off. There will be one driver who will need assistance to offload the mirrors.
Orders are accepted once the specified deposit is paid. Payment in full is required before delivery. All prices quoted are exclusive of VAT and delivery charges.
Deliveries will be by a third party. Any delivery date specified by the seller is an estimate only, not of the essence of the contract and is not guaranteed. It is essential that deliveries are accepted in person by the buyer or their authorised agent. Damaged goods should not be accepted and should be returned by the courier. If the buyer or their agent is not on hand at the time of delivery the goods will not be delivered and a further charge will be made for second or subsequent deliveries. Once the goods are offloaded and signed for any subsequent damage to the product, the buyer or their agent is the responsibility of the buyer. Mirrors are delivered without additional packaging and can be checked for damage after they are offloaded and before signing for safe receipt.
We strongly advise that you do not schedule any installation work before receipt of your mirrors. The seller will not be liable, or accept any charges relating to any costs resulting from a late, incorrect or damaged delivery.
For any orders cancelled after delivery under the Consumers Contracts Regulations 2014, the cost of return is the responsibility of the buyer. Refunds will be paid once the goods have been received and inspected to ensure no damage has occurred.
Any bespoke orders cannot be cancelled once production has started. In such cases the charge will be made for any materials or labour applied.
The seller is committed to ensuring that your privacy is protected and complies with the General Data Protection requirements. Certain information is needed from you to process your order. By providing this information you agree to its use by us for completion of orders and subsequent marketing purposes. We do not disclose any private information to third parties other than those involved in the completion of your order and those third parties will not disclose your information to any other third party.
In the event the seller is prevented from carrying out its obligations as a result of any cause beyond its control such as – but not limited to – acts of God, Wars, Strikes, Lockout, Flood and failure of third parties to deliver goods the seller shall be relieved of its obligations and liabilities for as long as such fulfilment is prevented.
The seller shall under no circumstances whatsoever be liable for any indirect or consequential loss howsoever caused. The seller’s liability in respect of breach of any order shall be limited to the invoice value to which the claim relates.
The copyright of all material and images on the seller’s website remain the property of Beverley Brightman Dressage. In the event the products or information we provide result in property, physical or other harm we assume no liability.
